These Terms & Conditions apply to orders placed with A Little Cake, including orders placed in person, by telephone, text message, email, online, through an invoice or payment link, or through our website.
By placing an order, paying a deposit or balance, signing an order form, or otherwise approving an order, you acknowledge that you have reviewed and agree to these Terms & Conditions.
ORDERS & CUSTOMER APPROVAL
Customers are responsible for carefully reviewing all order details, including but not limited to event date, pickup or delivery date and time, cake size, servings, flavors, fillings, colors, design elements, inscriptions, spelling, names, ages, quantities, and any other specifications.
A Little Cake provides customers with order information for review. It is the customer’s responsibility to notify us promptly of any error or discrepancy.
Once an order has been approved and/or payment has been made, A Little Cake will produce the order according to the information contained in the confirmed order.
PAYMENTS & DEPOSITS
A deposit is required to reserve an order and event date. An order or date is not considered confirmed until the required deposit or payment has been received.
ALL DEPOSITS ARE NON-REFUNDABLE.
Orders placed during the week of the event may require payment in full at the time the order is placed.
For delivery orders, the balance must be paid in full by the payment deadline specified on the order or invoice.
Failure to make required payments by the applicable deadline may result in cancellation of the order without refund of amounts already paid.
ABSOLUTELY NO REFUNDS — NO EXCEPTIONS
ALL SALES ARE FINAL. ALL PAYMENTS AND DEPOSITS ARE NON-REFUNDABLE. NO EXCEPTIONS.
Our custom cakes and specialty products require advance scheduling, purchasing, preparation, design work, and allocation of production capacity. Once an order is accepted, we reserve production time specifically for that customer and may decline other orders as a result.
For these reasons, customer cancellation, a change in event plans, a change of venue, a reduction in guest count, failure to pick up an order, or another circumstance outside the control of A Little Cake does not entitle the customer to a refund.
Nothing in this policy limits any rights or remedies that cannot legally be waived under applicable law.
ORDER CHANGES
No changes may be made within seven (7) days of the scheduled order date, including changes to design, size, servings, flavor, filling, inscription, colors, pickup/delivery date, or other order details.
Changes requested more than seven days before the order date are subject to availability and are not guaranteed. Additional charges may apply.
Any approved change must be confirmed by A Little Cake.
CANCELLATION POLICY
ALL SALES ARE FINAL. ALL DEPOSITS AND PAYMENTS ARE NON-REFUNDABLE. NO EXCEPTIONS.
If a customer chooses to cancel an order for any reason, any deposit or payment already made will not be refunded.
Because A Little Cake reserves production time, purchases ingredients and materials, schedules staff, and may decline other orders based on accepted orders, cancellation does not entitle the customer to a full or partial refund.
This policy applies regardless of the reason for cancellation, including changes in event plans, venue changes, reduced guest counts, scheduling conflicts, weather concerns, illness, or other circumstances outside the control of A Little Cake.
Cancellation of an event or order does not cancel or reverse charges for payments already made.
Nothing in this policy limits any rights that cannot legally be waived under applicable law.
CUSTOM DESIGNS & ARTISTIC VARIATION
Our cakes and desserts are handcrafted. Photos, drawings, invitations, color swatches, Pinterest images, social-media images, and other reference materials are used as inspiration and guidance.
Unless specifically agreed otherwise in writing, A Little Cake does not guarantee an exact duplication of another cake or reference image.
Customers acknowledge that reasonable variations may occur in colors, proportions, placement, textures, flowers, decorations, handwriting, edible images, and other handcrafted elements.
Different materials—including buttercream, fondant, modeling chocolate, edible printing, and food coloring—may produce different shades and finishes. We will make reasonable efforts to achieve requested colors and designs as closely as practical.
SERVING SIZES
Serving quantities are estimates based upon standard cake-serving guidelines.
Actual servings obtained from a cake depend upon how the cake is cut. A Little Cake is not responsible for fewer servings resulting from portions being cut larger than the recommended serving size.
ALLERGIES & FOOD SENSITIVITIES
A Little Cake is a peanut-free bakery in that peanuts are not intentionally used as ingredients; however, we cannot guarantee that ingredients are manufactured or processed in peanut-free facilities.
Products may contain or come into contact with milk, eggs, wheat, soy, tree nuts, and other allergens. Cross-contact is possible.
Customers with severe allergies or food sensitivities must notify A Little Cake before ordering. Customers are responsible for communicating relevant allergy information to their guests or anyone consuming the products.
We cannot guarantee an allergen-free environment.
PICKUP & TRANSPORTATION
Customers picking up cakes or other products assume responsibility for the order once it leaves A Little Cake’s possession.
Cakes should be transported on a flat, level, secure surface in an air-conditioned vehicle and should not be placed on a seat, lap, or other uneven surface.
A Little Cake is not responsible for damage caused after pickup, including damage resulting from transportation, sudden braking, improper handling, heat, sunlight, improper storage, pets, children, road conditions, or failure to follow handling instructions.
DELIVERY
When delivery has been purchased and confirmed, A Little Cake will make reasonable efforts to deliver the order to the agreed location and within the agreed delivery timeframe.
Once the order has been delivered and accepted by the customer, venue, caterer, event planner, coordinator, or other authorized recipient, responsibility for the order transfers to the customer.
A Little Cake is not responsible for damage occurring after delivery due to movement, handling by venue personnel or other third parties, environmental conditions, heat, humidity, unstable tables, decorations added by others, or other circumstances outside our control.
FRESH FLOWERS, TOPPERS & CUSTOMER-SUPPLIED ITEMS
If a customer, florist, event professional, or other third party supplies flowers, toppers, figurines, decorations, or other items for use with a cake, A Little Cake is not responsible for the quality, safety, condition, structural suitability, or performance of those items.
Additional charges may apply for placement or installation.
PHOTOGRAPHS
Unless otherwise agreed in writing, A Little Cake may photograph products we create and may use those photographs for our portfolio, website, social media, advertising, or other promotional purposes.
We will not intentionally publish a customer’s private personal information in connection with such photographs without permission.
PAYMENT DISPUTES & CHARGEBACKS
By making payment, the customer acknowledges that the charge is authorized and relates to the order described in the applicable order confirmation, invoice, receipt, or agreement.
Before initiating a payment dispute or chargeback, customers are encouraged to contact A Little Cake directly so that we have an opportunity to review and address the issue.
A Little Cake reserves the right to provide the customer’s signed agreement, order confirmation, correspondence, payment records, proof of pickup or delivery, photographs, and other relevant documentation to the payment processor or financial institution when responding to a payment dispute or chargeback.
Nothing in this section limits a customer’s rights under applicable federal or state law or the rules of the applicable card issuer or payment network.
WEBSITE INFORMATION
We make reasonable efforts to keep information on our website accurate and current. However, prices, product availability, designs, flavors, policies, and other information may change.
Website photographs are examples and may not represent the exact appearance of a handcrafted product.
INTELLECTUAL PROPERTY
Content appearing on the A Little Cake website, including original photographs, graphics, logos, text, and designs, is owned by or licensed to A Little Cake and may not be reproduced or used commercially without permission, except as otherwise permitted by law.
Customers who provide photographs, logos, characters, artwork, or other materials for reproduction represent that they have permission or authority to request their use. A Little Cake may decline any design or reproduction request at its discretion.
EVENTS BEYOND OUR CONTROL
A Little Cake will not be responsible for a delay or inability to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, utility failures, government orders, transportation interruptions, equipment failures, supply disruptions, emergencies, or other extraordinary circumstances.
If such circumstances materially affect an order, A Little Cake will communicate with the customer regarding available options.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, A Little Cake’s liability arising from an order shall not exceed the amount paid to A Little Cake for the specific product or order giving rise to the claim.
A Little Cake will not be liable for indirect, incidental, special, or consequential losses to the extent such limitations are permitted by applicable law.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
Before pursuing a dispute, customers are encouraged to contact A Little Cake directly so that we have an opportunity to attempt to resolve the matter.
SEVERABILITY
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
CHANGES TO THESE TERMS
A Little Cake may update these Terms & Conditions periodically. The version applicable to an order will generally be the version in effect when the order is placed, unless otherwise agreed or required by law.
